Cancellation Policy
1. Applicability
This Cancellation Policy applies to all services (including AI-driven digital marketing projects, assessments, consulting, and implementation) provided by Impact Focused Solutions (dba GrowthUplift) to its clients. It governs cancellations made within 14 days from the Project Commencement Date.
2. Definitions
  • “Project Commencement Date”: The date on which GrowthUplift begins deliverables or upon receipt of any advance payment, whichever occurs first.
  • “Cancellation Request”: A written notification from the Client expressing their intent to cancel the project under this Policy.
  • “Prepaid Fees”: Any amounts paid by the Client in advance of invoicing for services not yet rendered as of the Project Commencement Date.
3. Cancellation Right
Clients may cancel any project without cause by submitting a Cancellation Request within 14 calendar days of the Project Commencement Date. This right is provided under Indian consumer protection law, which entitles consumers to withdraw from a service contract within 14 days of initiation.
4. Cancellation Procedure
To cancel a project, the Client must:
  • Include the project name, Project Commencement Date, and any relevant invoice or proposal references.
GrowthUplift will acknowledge receipt of the Cancellation Request via email within two business days.
5. Effects of Cancellation
Upon acceptance of the Cancellation Request:
a. Service Cessation
GrowthUplift will promptly cease all work on the project.
b. Refund of Prepaid Fees
The Client is entitled to a refund of any Prepaid Fees for services not yet rendered, calculated on a pro rata basis up to the Project Commencement Date.
c. Administrative Breakage Fee
To cover administrative costs and any direct expenses incurred, GrowthUplift may retain a breakage fee not to exceed 25% of the total project fees.
6. Processing of Refunds
Refunds will be processed within 14 calendar days of GrowthUplift’s acceptance of the Cancellation Request. Refunds will be issued via the original payment method. If that method is unavailable, an alternative mutually agreed payment method will be used.
7. Governing Law and Jurisdiction
This Cancellation Policy and any dispute arising from it are governed by the laws of India, specifically the Information Technology Act, 2000, and applicable regulations enforced in Maharashtra. The courts of Pimpri-Chinchwad, Maharashtra, have exclusive jurisdiction over any disputes.
